Nigeria Wins Massive Mambilla Hydro Legal Battle: ICC Dismisses Sunrise Power’s $680M Claim
ABUJA, NIGERIA — The Federal Government of Nigeria has secured a major victory on the international stage after an International Arbitration Tribunal in Paris completely rejected a multi-million-dollar claim brought against the country by Sunrise Power and Transmission Company Limited (Sunrise).
The ruling, delivered on September 17, 2026, clears the single biggest legal hurdle that has paralyzed the critical 3,960-megawatt Mambilla Hydroelectric Power Project in Taraba State for years.
The Dispute
Sunrise Power had instituted the arbitration under the auspices of the International Chamber of Commerce (ICC), demanding a $680 million settlement sum and interest. The demand was tied to a separate, larger arbitration where the firm is claiming over $2.7 billion in compensation regarding disputes over the Mambilla project.
The legal battle dates back to a 2003 contract to build the hydroelectric plant under a build-operate-transfer model. However, the Nigerian government established that the Federal Executive Council never authorized the contract, rendering it illegal.
A Rare Bipartisan Defense
In a historic show of patriotism, key political figures united to defend the nation’s interests. Both former President Olusegun Obasanjo and the late President Muhammadu Buhari testified in the case.
Other high-profile witnesses and key actors who actively participated in dismantling the claims included former ministers Babatunde Raji Fashola, SAN, and Suleiman Adamu as well as the National Security Adviser (NSA) and the Economic and Financial Crimes Commission (EFCC), which led investigations into the case.
President Tinubu Reacts
In an official State House statement, President Bola Ahmed Tinubu commended the legal victory and praised the defense team led by the Attorney-General of the Federation, Prince Lateef Fagbemi, alongside Ms. Elizabeth Oger-Gross and Mr. Tolu Obamuroh of Paul Hastings LLP.
“This latest decision affirms the Nigerian State’s determination not to succumb to predatory and exploitative claims by corrupt local and international entities and their enablers and funders,” President Tinubu stated.
While assuring the public that Nigeria remains fully committed to partnering with genuine investors and honoring legal obligations, the president emphasized that the country will continue to fiercely defend its commonwealth against opportunistic claims.
